The story ran as the Education Department dropping a civil rights standard. The Federal Register shows nine agencies did it, and the docket numbers are all in a three-week window.

Education (2026-15019), Health and Human Services (2026-15000) and Defense (2026-14983) all published on July 24. AmeriCorps proposed its version on July 23, alongside a second Education action rescinding vocational-education guidelines. State moved on July 9, the EEOC and NASA on July 6, Labor on July 2 [2]. The Department of Justice went first, in December 2025 [3].

All of it conforms to Executive Order 14281 [1].

How the Education rule was made

Its own text is the record, and three facts sit in it [1]:

It took effect the day it published. July 24, no delay.

It received zero public comments.

It skipped notice-and-comment rulemaking entirely, under the Administrative Procedure Act exemption at 5 U.S.C. 553(a)(2), which covers rules relating to grants, benefits or contracts.

Those three facts belong together. Zero comments is not evidence that nobody objected. It is a description of a process in which nobody was asked.

What was struck

Seven paragraphs: 34 CFR 100.3(b)(2), 100.3(b)(6), 100.3(c)(2), 100.3(c)(3), and 100.5(g), (h) and (i) [1].

Together they were the machinery for finding a Title VI violation on the basis of discriminatory effect. Without them, the Office for Civil Rights must show discriminatory intent - that someone meant it. The main application of the effects standard has been school-discipline disparities, where intent is close to unprovable and the numbers are the entire case.

A benefit with no number attached

The docket abstracts advertise reduced compliance costs, and the Defense and Labor abstracts make similar claims [2].

The Education rule itself says the overall cost effect is difficult to quantify, and gives no dollar figure and no hour figure [1].

An agency claiming a rule saves money, declining to say how much, and adopting it without asking anyone, in a document that took effect the moment it appeared.
